TERMS AND CONDITIONS

 

1.  MAKING YOUR BOOKING

To book your accommodation you will need to send written confirmation or an e-mail confirming all the names, in full, of your party, your full postal/residential address and contact telephone numbers. We also need a deposit (this is non-refundable) which will secure your booking. The lead guest on the e-mail will be responsible for the full cost of the rental including any amendments or charges. Once your deposit is received you agree to be bound by these Terms and Conditions.

 

2.  PAYMENT OF YOUR BOOKING

The non-refundable deposit must be paid immediately to confirm and secure your booking and the remaining balance (which includes the villa rental, less the non-refundable deposit, plus US taxes, any pool/spa heating and/or BBQ hire etc, if requested) together with the security deposit, will need to be paid in full 12 weeks before you travel (If your booking is less than 12 weeks away, then the full balance will be due immediately). The security deposit is refundable 30 days after the departure of your party and subject to a successful property audit.  (Successful property audit means that there is no damage to the villa or the villa’s inventory by your party and that no inventory items are missing after the departure of your party)  A property audit is carried out after each party departs from the villa.  If any damage has occurred to the villa or the villa inventory by your party, or any villa inventory items are missing after the departure of your party, then the security deposit will be retained to pay for the cost of repair or replacement.

 

3.  CONFIRMATION OF YOUR BOOKING

Our contract is made when we receive your non-refundable deposit and e-mail detailing the names of all the members of your party, your full residential/postal address and contact telephone numbers. Once these are received we will send you confirmation showing the dates booked and the full price of the booking.

 

4.  CANCELLATION OF YOUR BOOKING

If you need to cancel for any reason, you must inform us as soon as possible by email, our cancellation policy fee structure is to charge the following Cancellation Charges:


Anytime after confirmation has been sent and prior to 12 weeks before arrival - Loss of deposit.

Between 12 and 8 weeks before arrival - 25% of the total price
Between 8 and 4 weeks before arrival - 50% of the total price
Less than 4 weeks before arrival – 100% of the total price

Failure to notify us of your cancellation - 100% of the total price 

 

If requested we will supply confirmation of the cancellation and the cancellation charges for you to pass on to your insurance company


5.  INSURANCE

Renters are advised to take out adequate travel insurance to cover all eventualities such as delays, cancellation, accident, sickness (medical insurance for the USA), luggage, personal belongings and damage.

 

6.  LIABILITY

The Owner or Management Company do not accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the villa or the villa inventory including the pool deck/lanai, pool or spa or surrounding areas or any facilities/inventory on Terra Verde. It is the responsibility of an adult member of the party to ensure that children are always properly supervised when in the villa or using the pool, spa, pool deck/lanai and surrounding areas or Terra Verde Resort and it's facilities/inventory.

 

7.  ARRIVAL & DEPARTURE TIMES

The villa will be available for occupancy from 4 pm on the first day of arrival and must be vacated by 10 am (prompt) on the morning of departure.

 

8.  OCCUPANCY

Florida state law prohibits sub-letting, sharing and assigning. Therefore only the persons listed on the booking e-mail are allowed to stay in the house, any persons not shown on the form may be asked to leave, if found in the villa by the Owner or Management Company. The renters guide book contains a floor plan clearly stating maximum occupancy levels.  Maximum occupancy is 12 persons.

The Lead Guest must register all guests with our Management Company within two days of arrival.

 

9.  UTILITIES

All rentals include electricity and water charges.

 

10.  COMPLAINTS OR DISSATISFACTION

In the unlikely event of a complaint during your stay please contact the Management Company (The telephone number is in the Renters Guide Book, which can be found in the villa).

 

11.  FORCE MAJEURE

The Owner or Management Company can not be held responsible or liable and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary, in respect of loss, damage or changes caused by Force Majeure (e.g. Due to war or the threat of war, riots, civil commotion, terrorist activities, natural or man made disasters, fire, strikes/industrial disputes, floods, adverse weather conditions, closure or congestion of airports, roads or railways, technical problems with transport, alterations or cancellations of schedules by carriers or any other events beyond our control).

 

12.  NO SMOKING POLICY

Please note that this property has a STRICT No Smoking Policy for the safety and comfort of all our guests. The NO SMOKING POLICY includes the villa, lanai and pool area.

 

13.  NO PETS POLICY

Strictly No Pets allowed in this property.

 

14.  RENTERS GUIDE BOOK

A Renters Guide Book is provided with useful information for you. Please do not remove this from the villa or deface it in any way.  This is meant for the use of all our guests.

 

15.  AIR CONDITIONING

If the air-conditioning is left running whilst the windows or doors are left open for any length of time, this will result in the unit working overtime and possibly freezing. This would cause the unit to stop working efficiently or fail. If this happens, the renter will be charged for the repair.

 

16. POOL EQUIPMENT

Pool equipment must not be tampered with or adjusted under any circumstances. If you have any issue with the pool, it's equipment or functioning, please contact the Management Company in the first instance.  Details of the Management Company can be found in the Renters Guide Book, which is located in the villa.  Any adjustment of the Pool equipment by any guest, which incurs a call out to the Management or Pool Maintenance Company will incur all costs from the Management, Pool or other Supplier being passed to the lead guest plus a £50 or US $80 processing fee. 

 

17. CARPETS AND FURNITURE

Stains and spillages on the carpets and/or furniture caused by members of your party will result in the lead guest incurring an additional charge for professional removal of the stains.

 

18. COUNTER TOPS / WORK SURFACES / TABLE TOPS

All hot appliances, cooking or baking equipment must not be placed directly on any Counter Top, Working Surfaces, Table Top or any other item of furniture or villa inventory without the use of the heat resistant mats provided. Therefore, please use the heat resistant mats provided. Any damage to any item as a result of placing hot items or substances on them will result in the loss of your security deposit and the lead guest being charged for any additional costs to repair or replace such items and any associated items.

 

19. NO MISUSE OF OR STANDING OR JUMPING ON OR REMOVAL OF ANY ITEM OF VILLA INVENTORY
Adults and Children are strictly NOT allowed to mis-use, stand or jump on or remove any item of the villa inventory in the villa or in the pool or on the pool deck area/lanai. This includes chairs, tables, sofas, loveseats, beds, cabinets, games room equipment - air hockey/table tennis/ping pong table, tables or stools, pool furniture or any other inventory item(s). This is for safety and damage purposes and any damage to villa inventory or any item of inventory is found to be missing which is caused by any Adult or Child staying at the villa as a result of mis-use, removal, standing or jumping on any item of villa inventory will mean loss of deposit plus any additional fees to repair or replace the damaged item. We accept no liability for any damage or injury to a person using the villa, it's inventory in the villa or in the pool, on the pool deck/lanai and surrounding areas or Terra Verde Resort facilities and inventory. It is the responsibility of an adult member of the party to ensure that children are always properly supervised when in the villa or using the villa inventory, pool/spa, pool deck/lanai and surrounding area including Terra Verde Resort and it's facilities/inventory. Any damage to the villa inventory or the villa itself will result in the loss of your security deposit and the lead guest being charged for any additional costs to repair or replace such items and any associated items.

 

20.  BUGS/ANTS

Florida is notorious for bugs and ants. This property is treated on a regular basis, however, if food is left out, in or around the villa or on the lanai/pool deck, this will attract bugs/ants and the renter will be charged if extra treatment is necessary through the deliberately leaving out of food. 

Therefore no food or drink is allowed in the bedrooms.

However, if you do experience problems despite being careful please contact the Management Company (The telephone number is in the Renters Guide Book) and they will come out to deal with it.

 

21.  PLUMBING

 

The plumbing system in the USA uses narrow pipes which can easily block.  Flushing excessive toilet paper, sanitary towels, diapers etc down the toilet will of course block the pipes and is strictly forbidden.  Any call out and repair expenses will be charged to the renter if this is a result of a blockage caused by your party.

 

22.  RULES OF THE HOUSE

On departure please remove the linen from the beds and place in the washing machine (If you have time when the wash cycle has finished please put into the dryer).

Please ensure the towels you have used are washed before you leave.

Please remove all food stuffs and place in the bin.

Please empty the bins into the dustbins and place out ready for collection.

Please ensure the dustbins are put out for collection the night before collection day. (See Renters Guide Book for the days of collection).

Please do not move any of the villa furniture or its inventory.

If the villa is left in an excessively dirty state and the above procedures are not followed, we have no choice but to charge an extra $250.00 for a spring clean.

Mechanical failure of any equipment in the villa, which is beyond our control - once this is reported to our management company, all efforts will be made to repair either using our Management Company Staff or Outside Contractors as soon as practicable and with as little disruption to our guests as possible.

Parking on the grass is strictly forbidden.

No trailers, boats or caravans can be parked or kept at the villa.

 

23  CODE OF CONDUCT

 

Terra Verde is a residential community and so the actions of all the members of your party should not interfere with the enjoyment of either other vacationers or the residents of Terra Verde.  Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience or nuisance to your neighbours after 10.30pm or before 07.30am.  In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any vacationers or the residents of Terra Verde or damage to any property, the Owners and/or their Management Company reserve the right to terminate your rental agreement immediately and forthwith.  The Owners or their Management Company will not be liable for any costs your party will incur, nor shall they pay any compensation, nor make any refunds due to this action.
